1. Introduction

Welcome to Notebook Studio, an AI-powered study platform that helps students learn faster by creating notebooks, uploading study materials, chatting with AI notebooks, and generating summaries, quizzes, and study aids from their own sources.

These Terms of Service ("Terms") form a legally binding agreement between you and Notebook Studio. By creating an account, subscribing to a plan, or using any part of the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

Throughout these Terms, "we", "us", and "our" refer to Notebook Studio and its operators. "Service" refers to the Notebook Studio website, mobile applications, and all related features, tools, and content we provide. "You" refers to the person using the Service.

2. Use of Our Service

You must be at least 16 years old to use the Service. By using Notebook Studio, you confirm that you meet this age requirement and that you have the legal capacity to enter into this agreement.

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by, any third party.

• You must not upload, generate, or share content that is unlawful, defamatory, threatening, harassing, or otherwise objectionable.
• You must not attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
• You must not use automated tools, scrapers, or bots to access, copy, or collect data from the Service without our prior written consent.
• You must not resell, redistribute, or commercially exploit the Service or any part of it without authorization.

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or that your continued use poses a risk to the Service or other users.

3. Account and User Responsibilities

To use most features of the Service, you need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

• You agree to provide accurate, current, and complete information when creating your account and to keep it up to date.
• You are responsible for safeguarding your password and for any use of your account, whether authorized by you or not.
• You must notify us immediately if you suspect any unauthorized use of your account or any other security breach.
• You are responsible for the study materials, sources, and documents you upload, and you confirm you have the right to upload and use them.

You retain ownership of the content you upload to the Service. By uploading content, you grant us a limited license to store, process, and use that content solely to provide and improve the Service, including passing it to AI providers to generate summaries, answers, and study aids on your behalf.

4. Subscriptions, Payments, and Credits

Notebook Studio offers both free and paid subscription plans. Paid plans provide access to additional features, higher usage limits, and premium capabilities as described on our pricing page.

All purchases are final sales. Except where required by applicable law or as described in our Refund Policy, subscription fees are non-refundable. When you purchase a subscription, you authorize us to charge the payment method you provide.

• Subscriptions are billed on a recurring basis (monthly or annually) until cancelled. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
• You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access until that period ends.
• Payments are processed by our payment providers, including Stripe, PayPal, Razorpay, and Flutterwave depending on your location and chosen method. We do not store your full card details on our servers.
• Prices may change over time. If the price of your subscription changes, we will notify you before the new price takes effect, and you will have the option to cancel.
• If a payment fails, we may attempt to retry it or suspend access to paid features until the payment is settled.

5. Data Retention and Deletion

We retain your account information and uploaded content for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.

If you delete your account, we will delete or anonymize your personal data and uploaded content, subject to any legal retention requirements and legitimate business needs such as fraud prevention and record keeping. Some data may be retained in backup systems for a limited period before being permanently removed.

6. Third-Party Services

The Service relies on and integrates with third-party services, including AI providers (such as Google Gemini), payment processors, and infrastructure providers. These services are governed by their own terms and privacy policies, which we encourage you to review.

AI-generated content is provided for informational and study purposes only. While we work to provide helpful and accurate output, AI responses may contain errors, omissions, or inaccuracies. You are responsible for reviewing and verifying any AI-generated content before relying on it.

We are not responsible for the content, availability, or practices of any third-party websites or services that may be linked to or used within the Service.

7. Intellectual Property

The Service, including its design, software, text, graphics, logos, and other materials, is owned by or licensed to Notebook Studio and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

You retain ownership of the content you upload. Output generated by the Service from your content is provided for your personal study use. Nothing in these Terms transfers any ownership or intellectual property rights to you beyond the limited right to use the Service as described here.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Notebook Studio and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service.

Our total liability to you for all claims arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Changes to the Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top of this page and notify you where appropriate.

Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree with the updated Terms, you should stop using the Service and, if applicable, cancel your subscription.
